TERMS AND CONDITIONS FOR SALE
The Following Terms and Conditions for Sale shall apply to all purchases made from BESTSELLER Stores US LLC, 1209 Orange Street, Wilmington, Delaware 19801 (“BESTSELLER,” “We,” “Us,” and “our”) by customers purchasing Products via the Website. These Terms and Conditions for Sale are incorporated into and made a part of the Terms. By placing an order through the Website, you represent and warrant that you are a bona fide end-user customer and will not deliver, sell or otherwise distribute our Products or purchase our Products for commercial purposes or any other commercial benefit.
1. Conclusion of Contract
A final and binding contract has been concluded between you and BESTSELLER when your order has been confirmed by BESTSELLER. BESTSELLER will send an order confirmation to you by email when the order has been confirmed and shipped. The order receipt or notice on the Website received immediately after placing the order does not constitute an order confirmation.
You are only allowed to purchase Products on the Website if you are a private consumer, i.e., not a business customer, retailer, or reseller.
2. Prices, taxes and delivery
All prices on our Website are stated in U.S. dollars; you are solely responsible for any fees or charges you may incur with respect to currency conversion. All prices on our Website are stated exclusive of sales, use, and other taxes, but applicable taxes will be added to your invoice prior to your acceptance to make your online payment. To the extent use tax is applicable, it is up to you to calculate, report, and pay such tax. The applicable price is the one stated on the Website for the relevant Product on the date that you place your order.
BESTSELLER reserves the right to amend any prices incorrectly stated on the Website. Furthermore, BESTSELLER reserves the right to amend any prices, taxes and/or other costs stated on the Website at any time, e.g., due to changes in sales tax rates or other public fees and charges, increased costs or as a result of the general development in prices.
Please note that some banks do charge an extra overseas transaction fee, as we have a U.S. bank account. This fee is charged by the bank (and not BESTSELLER) and will not be reimbursed by BESTSELLER. For more information, please contact your bank.
When ordering Products on the Website, shipping costs will be added to your invoice prior to your acceptance to make your online payment. The amount will depend on the choice of shipping method and the location of your address.
3. Payment
Before you pay any amounts, you will have an opportunity to review and accept the fees that you will be charged.
When ordering Products through the Website, it is possible to use the following payment options:
• Credit and debit card (VISA, Mastercard, AMEX, Maestro)
This payment method requires a valid credit or debit card. We reserve the right to check the validity of the card and to seek pre-authorization of your credit card account to ensure it has the necessary funds available to cover the purchase. The amount will be reserved on your card and will be debited after shipment of the Products.
• BESTSELLER Gift Card
You can pay for your order fully or partially with your BESTSELLER gift card. If the balance on your gift card exceeds the order amount, the balance on your gift card will be adjusted accordingly.
• PAYPAL
This payment method requires a PayPal account, which you will need to log into during the payment process. If you do not have a PayPal account, you can easily set one up for free on their website.
All payments are subject to validation and authorization by both the card issuer/payment provider and BESTSELLER, to maintain security and prevent fraud. We reserve the right to decline certain payment methods and/or refer to a different payment method depending on the circumstances. You authorize BESTSELLER to charge all sums as described in these Terms and Conditions of Sale, for the Products you select, to the payment method you select.
YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY PAYMENT CARD(S) OR OTHER PAYMENT METHOD(S) USED IN CONNECTION WITH ANY TRANSACTION.
4. Club Benefits
If you sign up as a Jack & Jones club member, you will be eligible for the Jack & Jones Customer Club Benefits, subject to the additional terms set forth in the Jack & Jones Customer Club Terms.
5. Gift Cards
BESTSELLER gift cards are prepaid cards that have no monetary value unless activated. Gift cards are not redeemable for cash, returnable, or eligible for refunds, and the value of a gift card will not be replaced if it is lost, stolen, altered, or destroyed. Offer codes and other discounts or promotional offers do not apply to the purchase of gift cards.
By purchasing a BESTSELLER gift card, you accept these Terms and the terms and conditions of BESTSELLER’s third-party gift card vendor, fashioncheque USA LLC, available at https://fashioncheque.com/media/bestseller/march2025/usa-eng-bs-gtc-holders-v_1.2_2025.pdf. Each transaction made using a gift card is debited against the gift card balance. If a transaction exceeds the gift card balance, the user must pay the difference between the transaction amount and balance. The gift card becomes inactive once the card value is depleted. Gift cards may not be resold by any unauthorized third parties, and BESTSELLER will not honor gift cards purchased from unauthorized third parties. We reserve the right, in our sole discretion, to invalidate any gift cards that we have a good faith reason to believe were obtained fraudulently or via other illegal or inappropriate means.
6. Store Credit; Promotional Codes
We may issue store credits or promotional codes on case-by-case basis in our sole discretion. If issued, store credits will not expire and may be used toward the purchase of any Products sold on the Website. Store credits are not redeemable for cash. Refunds for orders paid for with store credit will be applied as store credit back to the same account from which the purchase was made. If you are granted a refund for an order paid for with multiple methods of payment, any refund is first applied to the payment card or PayPal account, up to the original amount charged, and the remainder will be applied as store credit to your user account. Promotional codes expire on the date of expiration on our original promotion offer, and we reserve the right to invalidate promotional codes that we have a good faith reason to believe were obtained fraudulently or via other illegal or inappropriate means.
7. Prevention of Fraud
We reserve the right to limit quantities on orders placed by the same account, placed by the same method of payment, and/or that use the same billing or shipping address. We will notify you if such limits are applied to you.
BESTSELLER reserves the right to prevent persons from shopping via the Website in case of a high number of returns. Moreover, deactivation of your customer account may also be triggered by suspected fraud (as determined by BESTSELLER in its sole discretion).
8. Shipping; Delivery
Unless you have been informed otherwise, the usual time of delivery from the time of placing the order is 6-8 business days .
Products ordered via the Website can only be delivered to addresses in the states and territories in the United States listed on the Website’s shipping address shipping address page.
BESTSELLER is not obliged to deliver Products that are out of stock. We will notify you if a Product you ordered is out of stock.
From time to time, the Website may display certain shipping-related promotions or offers, such as free shipping and/or returns. Please note that such promotions and offers are subject to additional terms and conditions that are provided when such promotions and/or offers are available on the Website. In all instances, any shipping promotions and offers are valid only within the continental United States.
9. Return of Goods
Products marked as “Final Sale” or “Non-Returnable” are not eligible for return or exchange. Intimate apparel and accessories, underwear, and personalized items, regardless of whether marked as final sale, are not subject to return or exchange at any time.
Except for the Products described above, we will accept a return of unused Products in their original condition for a refund of your purchase price, less the original shipping and handling costs.
Returns must be made without undue delay within 30 days after the date when you received the Products ].
Return of Products will be deemed in due time if, before expiry of the 30-day period, you have handed over the Products to the applicable postal in order to dispatch the return to BESTSELLER or you have returned the item to one of our physical stores. To retain proof that you have returned the Products within the return window, you should keep the receipt or return tracking number stating that you have handed over the Products to the postal services, for the purpose of dispatch.
You shall bear the direct cost of returning the Products (postage/freight), except that we may (but are not
required to) refund shipping costs in the event we confirm in our sole discretion that the Products shipped to you were defective when shipped. Used/impaired goods
• You may only return Products that are unused and in original condition.
• You are responsible for any impairment of the value of the Products caused by other handling, other than what is necessary to determine the nature, quality and function of the Products.
• Some of our Products are sealed with a special tag. This tag does not prevent you from trying on the Product, however, if the tag is removed, you may not return the Product.
Refunds
• Provided that the Products are unused, in original condition, and otherwise returned consistent with these Terms, we will refund all payments received from you (excluding shipping costs if the Products have been shipped), without unnecessary delay and in any event no later than 14 days after the date when we received the returned Products. Refunds will be credited to your original method of payment. Except as otherwise stated in these Terms, you will not be charged any fees by BESTSELLER as a result of the refund.
• We may withhold any refund until we have received the Products and evaluated their condition or until you have submitted documentation that the Products have been returned, as we determine may be appropriate.
10. Disclaimer of Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT, EXCEPT WITH RESPECT TO WARRANTIES THAT CANNOT BE WAIVED OR EXCLUDED UNDER APPLICABLE LAW, ALL PRODUCTS OFFERED ON THE WEBSITE ARE PROVIDED “AS IS,” TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE MAKE NO WARRANTIES WHATSOEVER WITH RESPECT TO THE PRODUCTS OFFERED ON THIS WEBSITE, INCLUDING, WITHOUT LIMITATION, ANY (A) WARRANTY OF MERCHANTABILITY; (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; OR (C) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE.
11. Ownership and Risk of Loss
All Products purchased via the Website will be delivered to you by a third-party delivery company, pursuant to a shipping contract. You shall become the owner of the Products and shall assume the risks of loss at the time of delivery of the Products by BESTSELLER to the third-party delivery company.
